
According to the decision, NSX Brasil proved that it had obtained authorization from the Prizes and Betting Secretariat (SPA) of the Ministry of Finance and had implemented the biometric systems necessary to prevent access by minors, as determined by one of the SPA's ordinances.
The defense was made by attorneys Bernardo Cavalcanti Freire and Leonardo Henrique Roscoe Bessa, partners at Betlaw and representatives of NSX Brasil.
“Considering that it was proven in the records that the defendant obtained the authorization to operate for a period of five years, it is concluded that the security mechanism indicated by the plaintiffs themselves and required by the Ministry of Finance was duly implemented,” says an excerpt from the decision.
The case is still ongoing and the plaintiffs have been summoned to present new evidence to prove the ineffectiveness of the biometric systems adopted by the betting company, in addition to justifying the request for access to the company's financial and registration data.
NSX, now part of Flutter Brazil, is a BetTech created after the merger between the international giant Flutter and the NSX Brasil system and holds a definitive license to operate fixed-odds betting in the country. The company was approved in the country to operate with the brands Betnacional, Mr. Jack Bet and Pagbet.
